1: Take advantage of waived filing fees by filing timely IDS’s when possible: IDS filing fees are waived for IDS’s filed prior to the first office action and for references cited in a counterpart foreign case within 3 months.
2: Accumulate references in real time, but do not file an IDS until necessary: Filing fees are reduced by accumulating references before filing an IDS.
3: File IDS’s as close to the notice of allowance as possible to avoid filing a continuation: By filing an IDS immediately after an applicant’s response, then periodically thereafter until there is either an office action or notice of allowance, most if not all references will be considered by the examiner prior to a notice of allowance, eliminating the need to file an RCE.
